An inmate at the North Nevada Correction Center will also have to spend time at a prison in Washington state for raping an Oak Harbor teenager three years ago, court documents indicate.

As part of a plea bargain, 29-year-old Michael Davis pleaded guilty in Island County Superior Court Nov. 16 to rape in the third degree.

Under the joint agreement, both the prosecution and defense will recommend at a Dec. 7 hearing that the judge sentence Davis to five years in prison, which is the top of the standard sentencing range.

Davis was originally charged with second-degree rape, which could have meant more than 10 years in prison.

The Oak Harbor police used DNA evidence to build the case against Davis.

According to a report by Detective Teri Gardner, the 15-year-old girl reported that Davis had raped her at a gathering at an Oak Harbor home in March of 2006.

After the girl drank alcohol and passed out, Davis raped her, the report states.

In an interview with police, Davis denied that he had sex with the girl. But the detective sent the girl’s underwear to the state patrol crime lab. The technicians matched the DNA to Davis, at least to the probability of 1 in 75 trillion.
